Organizer terms

These terms apply to every organization ("you") that creates games on OpenBar Games ("the platform"). By creating an organization you agree to them.

1. You are the operator

You are the official operator and sponsor of every game you run. You are responsible for following all laws that apply to it, including Florida Statute 849.094 (game promotions) or, for charitable nonprofit organizations, the charity rules that apply instead. The platform provides software only and is not a party to your promotion.

2. Every game is free to enter

  • Never require an entry fee, payment, donation, ticket or proof of purchase to join, pull a card, or win.
  • Watch for hidden purchases: if a stop is at a bar or event, players must be able to get their card without buying anything. Staff can deal any card using "Deal next card".
  • Never sell cards, extra pulls or better odds.

3. Prizes over $5,000

If the total value of prizes in a game is over $5,000, you must file with the Florida Department of Agriculture and Consumer Services at least 7 days before the game starts, keep a trust account (or bond) covering all prize value, and send them a list of winners of prizes worth more than $25 afterward. The platform shows a warning but does not file for you.

4. Rules, advertising and fairness

  • Post official rules where players play and include them (or a link) in your advertising. The platform shows them before players join.
  • Do not use misleading advertising or misstate prizes or odds.
  • Award every prize you offer. Do not change prizes or rules after a game starts in a way that hurts players.
  • Only remove an entry for breaking rules that players agreed to up front, such as duplicate entries or tampering. Never remove entries arbitrarily.

5. Prohibited prizes

Do not offer firearms, ammunition, drugs, lottery tickets, gambling credits, adult content, or anything illegal to give away. Alcohol prizes are for verified adults 21+ only. The automatic prize check is a helper, not legal approval.

6. Player data

  • Use player contact details only to run the game, plus marketing for players who opted in.
  • Share data with sponsors only for players who opted in to that sponsor.
  • Honor requests to unsubscribe or delete data.

7. Taxes and liability

You handle prize fulfilment, winner tax forms (such as IRS 1099 for prizes of $600 or more) and any claims about your promotion. You agree to hold the platform harmless from claims arising from your games.

8. Suspension

We may suspend games that require payment, offer prohibited prizes, or break these terms.
